We reserve the right to refuse service, for any reason, at any time. By agreeing to these Terms and Conditions, you hereby agree to have also read our Care Guide.

 

Return Policy

We do not accept returns or exchanges due to the delicate nature of the products we sell. 

We guarantee our plants for 10 days after delivery as long as the plants have not been removed from the original substrate and our Care Guide has been followed.

We do not compensate for damage that is considered reasonable shipping stress, this includes minor leaf folds, minor yellowing/browning or minor leaf drop compared to the plant's size.

Repotting or cutting the plant within the first 10 days will void our 10-day guarantee. 

Failure to adhere to our Care Guide will also void our guarantee.

If you received a damaged plant, we kindly ask that you contact us at orders@curvyplants.com and provide pictures of the plant within 10 days of delivery. We will provide next steps within 48 hours. 

We reserve the right to determine the appropriateness of care before completing a claim for damage. 

 

Cancellation Policy

We will gladly accept cancellation requests within 24 hours of purchase. 

To cancel an order before your order ships, please email your name and order number to orders@curvyplants.com.


 We will not be held responsible for damage to the plants as a result of failed delivery attempts.

When purchasing a plant from us, you are hereby agreeing to the terms outlined above.

Your privacy is important to us.

This Privacy Policy describes how www.curvyplants.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site. It is Curvy Plant Co.'s policy to respect your privacy regarding any information we may collect from you across our website. 

We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent at all times. We also let you know why we’re collecting it and how it will be used.

We only retain collected information for as long as necessary to provide you with your requested service. We’ll protect any collectd data within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

We don’t share any personally identifying information publicly or with third-parties, except when required to by law.

When you use our site, we will collect tracking information such as your browser type, the type of operating system you use, the domain name of your Internet service provider, and pages visited on the site. None of this information identifies you personally; we collect it for reporting purposes in order to improve our services.

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.

You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.

How We Store Your Personal Data

Where you provide us with data online it is stored securely by Shopify. Shopify is the provider of our website hosting, content management system and e-commerce platform.

We take the security of your personal data very seriously. In particular we ensure that appropriate security measures are in place to protect your personal data.

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through the contact information above. 

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Mobile Terms of Service

The Curvy Plant Co. mobile message service (the "Service") is operated by Curvy Plant Co. (“Curvy Plant Co.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Curvy Plant Co.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Curvy Plant Co. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Curvy Plant Co.. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18775227121 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Curvy Plant Co. mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
